Recent arguments claim that behavioral science has focused – to its detriment – on the individual over the system when construing behavioral interventions. In this commentary, we argue that tackling economic inequality using both framings in tandem is invaluable. By studying individuals who have overcome inequality, “positive deviants,” and the system limitations they navigate, we offer potentially greater policy solutions.

Abstract Three recent books on public opinion attempt to map changes in the public's policy preferences over the last few decades. Such changes have clearly occurred, but a single, overriding ?public mood? remains elusive. Rather, different components of the public mood seem to move in different directions. Furthermore, it is unclear how much of the apparent change in public mood is real and how much is an artifact resulting from changes in public policies. Der fünfte Band der Reihe trägt den Titel Ethik und Politik aus interkultureller Sicht. Neben einer begrifflichen, methodischen und inhaltlichen Klärung, was aus interkultureller Sicht bedeutet, werden in den verschiedenen Beiträgen ethische und politische Ansätze im heutigen Weltkontext der Philosophie erörtert. Interkulturell orientiertes philosophisches Denken weist alle Zentrismen zurück, ohne jedoch die jeweilige kulturelle Sedimentiertheit in Frage zu stellen. Folgerichtig wird so auch ein jeder Monismus abgelehnt. Das heutige Angesprochensein der Kulturen verlangt von uns, von den beiden Fiktionen einer totalen (...) Identität und völligen Differenz unter den ethischen und politischen Modellen Abschied zu nehmen. Die These von der Überlappung zielt auf das Wahrnehmen von grundsätzlichen Ähnlichkeiten und erhellenden Differenzen in den Ansätzen. Wer einen Pluralismus bejaht, muß auch bereit sein, im Geiste der Toleranz die unterschiedlichen Ansätze zur Ethik und Politik ernst zu nehmen. Wer den Konsens zu sehr betont, liebäugelt mit irgendeinem Identitätsmodell, vernachlässigt den Kompromiß. Tatsache ist jedoch, daß gerade Kompromisse zur Konfliktlösung beitragen. So sind die Beiträge dieses Bandes dem Ziel gewidmet, sowohl eine theoretische Begründung als auch eine praktische Bewältigung der interkulturellen Verständigung in Ethik und Politik zu leisten. This book is an attack on the widespread assumption that the mind has parts and that it is the interaction between these parts which accounts for the irrational behaviour displayed un self- deception and weakness of will.

Aim To study the views of people in a largely Muslim country, Kuwait, of the acceptability of a life-ending action such as physician-assisted suicide (PAS). Method 330 Kuwaiti university students judged the acceptability of PAS in 36 scenarios composed of all combinations of four factors: the patient's age (35, 60 or 85 years); the level of incurability of the illness (completely incurable vs extremely difficult to cure); the type of suffering (extreme physical pain or complete dependence) and the extent to (...) which the patient requests a life-ending procedure, euthanasia or PAS (no request, some form of request, repeated requests). In all scenarios, the patients were women who were receiving the best possible care. The ratings were subjected to cluster analysis and analyses of variance. Results Five clusters were found. For 44%, PAS was always very unacceptable, no matter what the circumstances. For 23%, it was unacceptable, but less so if the patient was older or requested it repeatedly. For 16%, it was unacceptable if the patient was young but was acceptable if the patient was elderly. For 5%, it was unacceptable if the patient had extreme pain but was acceptable if completely dependent. For 11%, it was unacceptable if the patient did not request it but acceptable if she did. Conclusion The majority of the Kuwaiti university students opposed PAS either categorically or with a slight variation according to circumstances. Nonetheless, a minority approved of PAS in some cases, particularly when the patient was elderly. (shrink)

On the mathematical foundations of theoretical statistics.

Epistemic decision theorists aim to justify Bayesian norms by arguing that these norms further the goal of epistemic accuracy—having beliefs that are as close as possible to the truth. The standard defense of Probabilism appeals to accuracy dominance: for every belief state that violates the probability calculus, there is some probabilistic belief state that is more accurate, come what may. The standard defense of Conditionalization, on the other hand, appeals to expected accuracy: before the evidence is in, one should expect (...) to do better by conditionalizing than by following any other rule. We present a new argument for Conditionalization that appeals to accuracy‐dominance, rather than expected accuracy. Our argument suggests that Conditionalization is a rule of coherence: plans that conflict with Conditionalization don't just prescribe bad responses to the evidence; they also give rise to inconsistent attitudes. Part of the Studies in Crime and Public Policy series, this book, written by one of the top philosophers of punishment, examines the main trends in penal theorizing over the past three decades. Duff asks what can justify criminal punishment, and then explores the legitimacy of actual practices by examining what would count as adequate justification for them. Duff argues that a "communicative conception of punishment," which he presents as a third way between consequentialist and retributive theories, offers the most (...) fruitful way of understanding punishment's meaning and justification. Duff addresses such questions as how much sentences should be constrained by proportionality requirements; what modalities of punishment best communicate their intended meaning; and what decisionmaking procedures he envisions. This book will appeal to criminologists, philosophers, and others interested in theories of punishment. (shrink)

After distinguishing different species of Legal Moralism I outline and defend a modest, positive Legal Moralism, according to which we have good reason to criminalize some type of conduct if it constitutes a public wrong. Some of the central elements of the argument will be: the need to remember that the criminal law is a political, not a moral practice, and therefore that in asking what kinds of conduct we have good reason to criminalize, we must begin not with the (...) entire realm of wrongdoing, but with conduct falling within the public realm of our civic life; the need to look at the different processes of criminalization, and to ask what kinds of consideration can properly figure in those processes; the need to attend to the relationship, and the essential differences, between criminal law and other modes of legal regulation. Some standards, such as moral and prudential standards, provide genuinely or authoritatively normative reasons for action. Other standards, such as the norms of masculinity and the mafia’s code of omerta, provide reasons but do not provide genuinely normative reasons for action. This paper first explains that there is a similar distinction amongst attitudinal standards: some attitudes (belief, desire) have standards that seem to give rise to genuine normativity; others (boredom, envy) do not. This paper gives a value-based account of which (...) attitudinal standards give rise to genuine normativity. It argues that this account has interesting implications before extending it to provide an account of which action-guiding standards are genuinely normative. It argues that this value-based account of which standards are genuinely normative is more plausible than alternatives suggested in the literature and has interesting implications for genuine normativity in law and aesthetics. It is argued that the Tractatus Project of Logical Atomism, in which the world is conceived of as the totality of independent atomic facts, can usefully be understood by conceiving of each fact as a bit in logical space. Wittgenstein himself thinks in terms of logical space. His elementary propositions, which express atomic facts, are interpreted as tuples of co-ordinates which specify the location of a bit in logical space. He says that signs for elementary propositions are arrangements of names. (...) Here, the names are understood as numerical symbols specifying coordinates. It is argued that, using this approach, the so-called colour-exclusion problem, which was Wittgensteins reason for abandoning the Tractatus, is in fact soluble. However, if logical space is a continuum then some coordinates will need to be expressed by numerical symbols that are infinite in size. How is this to be understood in Tractatus terms? It is shown that, in the Tractatus, Wittgenstein did recognise the possibility of infinite propositions and sentences expressing them. At first sight his approach to infinite sentences, and the approach of the present paper, seem to differ, but it is argued that the difference is superficial. Finally, we address the question of whether Logical Atomism is viable and this raises issues concerning its relationship to natural science. (shrink)

I begin by discussing the ways in which a would-be blamer's own prior conduct towards the person he seeks to blame can undermine his standing to blame her. This provides the basis for an examination of a particular kind of 'bar to trial' in the criminal law – of ways in which a state or a polity's right to put a defendant on trial can be undermined by the prior misconduct of the state or its officials. The examination of this (...) often neglected legal phenomenon illuminates some central features of the criminal law and the criminal process, and some of the preconditions for the legitimacy of the criminal law in a liberal republic.
